Privacy Policy
This Agreement describes Hilti’s policies and procedures on the collection, use, disclosure, and sharing of information from Hilti posted on, contained in, or relating to the Ask Hilti service (“Hilti Content”); and information from others posted on, contained in, or relating to the Ask Hilti service (“User Content”). Hilti Content and User Content are collectively “Information”. This includes Information on the Ask Hilti website, Ask Hilti content embedded on another site (such as a Ask Hilti “Follow” button), your mobile phone, or through one of Ask Hilti ’s applications for mobile devices (e.g., the Ask Hilti iPhone application) (collectively, the “Service”). All non-Hilti individuals, including you, who utilize or access the Service in any way are “Users”. By using or accessing the Service, you agree to be bound by all the terms and conditions of this Agreement. If you do not agree to be so bound, do not use the Service.
Hilti uses Information to prioritize product testing, develop products and services, identify user-based industry trends, analyze how the Service is used, diagnose service or technical problems, personalize content, remember information to help you efficiently access Information, monitor aggregate metrics such as total number of visitors, traffic, and demographic patterns, compilation of User list for purposes of direct marketing, and collect information on User Content and Users as necessary to comply with the Digital Millennium Copyright Act and other applicable laws.
The Service and Information is intended solely to exchange information between Hilti, and purchasers, end-users and specifiers of Hilti products (“Purpose”) – no other use is permitted, including but not limited to posting of information not directly related to the Purpose; or use of other User information for disclosure to others, advertising, or harassment or otherwise improper communication. To register, you are required to provide information about yourself, such as your name, occupation, employer, e-mail address and interests – it is your sole responsibility to keep such information current. Your name or username (you may select which one is visible), and other information you add to your profile and elect to make visible, will be available for public viewing on the Service. You may provide us with your mobile phone number if you choose to submit questions and receive answers via text message. We may use your email address to send you Service-related notices (including any notices required by law, in lieu of communication by postal mail). You can control receipt of certain Service-related messages on your Settings page. We may also use your contact information to send you marketing email messages. If you do not want to receive such messages, you may opt out by following the instructions in the message. If you correspond with us by email, we may retain the content of your email messages, your email address and our responses.
By using the Service, you represent and warrant to Hilti that: you are a person at least 13 years of age; you are legally permitted to use the Service; you take full responsibility for the selection and use of the Service; all information you provide is, to your knowledge, correct; and your use of the Service and Information will exclusively be to accomplish the Purpose. This Agreement is void where prohibited by law, and the right to access the Service is revoked in such jurisdictions. Access to the Service may be illegal by certain persons or in certain countries – you are solely responsible to determine whether your use of the Service is legally permissible. All Hilti Content is based on the codes, practices, standards, and Hilti published data of the country of Hilti’s address set forth on the Service website – it is the User’s sole responsibility to determine whether such Hilti Content is appropriate for use on specific projects, in local jurisdictions, or other countries.
If you use your Facebook, Twitter, or other social networking site (“SNS”) account information to sign in to the Service, we will collect and store your SNS user ID. If you connect your Service account with your SNS account (such as to enable posting from the Service), we will collect certain information from your SNS account (such as information from your SNS profile).
You may also provide User Content. Your questions, answers, and other contributions on the Service, and metadata about them (such as when you posted them), are publicly viewable on the Service, along with your name or username (you may select which one is visible). This information may be searched by search engines and be republished elsewhere on the Web. You agree that all User Content you contribute to the Service is perpetually and irrevocably licensed to Hilti, including the right and license to use, copy, cache, publish, display, distribute, modify, create derivative works and store such User Content and to allow others to do so in any medium now known or hereinafter developed, even if User Content is subsequently removed. You represent and warrant that you have the right to grant Hilti and others the rights set forth above. You represent, warrant and agree that you will not contribute any User Content which: (a) infringes, violates or otherwise interferes with any copyright, trademark, or intellectual property right of another party; (b) reveals any trade secret, unless you own the trade secret or have the owner’s permission to post it and are waiving any claim of confidentiality; (c) is libelous, defamatory, abusive, threatening, harassing, hateful, offensive or otherwise violates any law or right of any third party; or (d) contains a virus, trojan horse, worm, time bomb or other computer programming routine or engine that is intended to damage, interfere with, surreptitiously intercept or expropriate any system, data or information. Hilti reserves the right to remove/repost any User Content from/to the Service, without notice or liability.
Hilti may, at any time at its sole discretion and without notice or liability: cancel, delete, suspend or change the Service and/or any or all Information, including the availability of any feature, database, or Information; impose limits on certain features and services or restrict, suspend or terminate User access to parts or all of the Service; and/or modify the terms of this Agreement by posting the revised Agreement on the Service – Users are responsible for reviewing and becoming familiar with any such modifications, and use of the Service following such posting constitutes User’s acceptance of the terms of the Agreement as modified. Hilti undertakes no obligation to maintain or archive any Information – you are solely responsible to take measures to archive any Information you wish to preserve.
You agree Hilti has no fiduciary duty to any User. You agree Hilti has no control over, and no duty to take any action regarding: which Users gain access to the Service; what Information is accessed by Users; what effects the Information may have on a User; what User Content is posted on the Service, including Information which, if downloaded, may cause harm, or links to other websites which may be inappropriate or cause harm if accessed; how Users may react to, interpret or use the Information; or whether Information becomes obsolete or outdated. It is your sole responsibility to determine: whether and how to use Information; the accuracy of the Information; the Information’s relevance/applicability to your intended use; and that Information is current.
Any and all intellectual property rights which are or may be derived from the Service or Information belong solely to Hilti, and you agree to execute any document reasonably requested by Hilti to establish such ownership right. You agree to defend, indemnify and hold harmless Hilti, its directors, officers, employees, service providers, agents and affiliates (the “Hilti Group”), from claims relating to violation or breach of any representation or obligation in this Agreement (“Breach”), and User Content posted, by you (or anyone using your account with your permission), including costs and attorney fees. You agree to hold the Hilti Group harmless from any claim relating to any User Content and any Breach by any other User. The Service and Information is provided “AS IS” and “WITH ALL FAULTS”, without warranty of any kind, whether express or implied, including, without limitation, implied warranties of merchantability and fitness for a particular purpose, non-infringement, accuracy, copyright compliance, legality or decency. In no event shall the Hilti Group be liable for any damages of any kind or nature, under any theory of law, regardless whether such damages were foreseeable and/or due to any fault of the Hilti Group. Any and all disputes in any way relating to the Service or Information shall be governed by the laws of, and take place in, the jurisdiction of Hilti’s address set forth on the Service website, to the exclusion of any other jurisdiction.
